This DAOD applies to Regular and Reserve Force, as well as DND employees who act as managers\/supervisors of CAF members. Practically speaking, it requires that, in specific circumstances, any existing or new personal relationships be disclosed to the chain of command.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The policy update implements Recommendation #4 of the Report, which counsels better articulating, clarifying, and regulating personal relationships within the CAF. It accomplishes this by addressing power imbalance, privacy, and oversight.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Les politiques et les instructions des FAC doivent respecter l\u2019\u00e9quilibre entre les libert\u00e9s personnelles et la conduite professionnelle. La DOAD actualis\u00e9e pr\u00e9cise que les membres des FAC ont le droit d\u2019entretenir des relations personnelles avec d\u2019autres membres des FAC ou des employ\u00e9s du MDN sans crainte de repr\u00e9sailles ou de discrimination; elle exige toutefois que les relations personnelles ne nuisent pas \u00e0 la cr\u00e9ation d\u2019un environnement de travail professionnel, respectueux et empreint de solidarit\u00e9.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">\u00c0 cette fin, la politique mise \u00e0 jour clarifie la mani\u00e8re dont les relations personnelles sont g\u00e9r\u00e9es dans le contexte des FAC, soutient la cha\u00eene de commandement dans la mise en \u0153uvre de ces directives et place l\u2019int\u00e9grit\u00e9 et l\u2019\u00e9quit\u00e9 au c\u0153ur de cette approche. Elle pr\u00e9cise que, dans le cas des relations personnelles non divulgu\u00e9es impliquant un d\u00e9s\u00e9quilibre de pouvoir, notamment lorsqu\u2019il existe une diff\u00e9rence relative au grade, \u00e0 l\u2019autorit\u00e9 ou \u00e0 l\u2019influence, la relation sera pr\u00e9sum\u00e9e ne pas \u00eatre consensuelle, sauf si des \u00e9l\u00e9ments de preuve illustrent le contraire.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">This means that the onus is on individuals with the higher rank, authority, or influence to report such relationships to their chain of command. They also must demonstrate that the relationship was consensual, and that it did not result in any real or perceived disadvantage to the party with lesser power or authority.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Cette approche tient compte de la difficult\u00e9 inh\u00e9rente \u00e0 garantir un consentement v\u00e9ritable lorsque l\u2019une des parties exerce une autorit\u00e9 sur l\u2019autre. Elle vise \u00e0 prot\u00e9ger les membres des FAC et les employ\u00e9s du MDN contre toute forme d\u2019exploitation et \u00e0 maintenir la confiance, le professionnalisme et l\u2019\u00e9quit\u00e9 au sein de la cha\u00eene de commandement.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">De plus, les r\u00e9f\u00e9rences \u00e0 la \u00ab\u202ffraternisation\u202f\u00bb ont \u00e9t\u00e9 supprim\u00e9es de la DOAD. Ce terme est remplac\u00e9 par des d\u00e9finitions claires et un langage respectueux ax\u00e9 sur le professionnalisme et l\u2019int\u00e9grit\u00e9, qui constituent les principaux aspects de la recommandation formul\u00e9e dans l\u2019EEIC. Par ailleurs, le concept de \u00ab\u202frelation personnelle pr\u00e9judiciable\u202f\u00bb a \u00e9t\u00e9 aboli.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span
