Message du MDN : Loi visant \u00e0 moderniser le syst\u00e8me de justice militaire<\/strong><\/h3>\n

Coll\u00e8gues,<\/span><\/p>\n

Aujourd\u2019hui, j\u2019ai pr\u00e9sent\u00e9 un projet de loi visant \u00e0 modifier la <\/span>Loi sur la d\u00e9fense (LDN)<\/span><\/i><\/a>. Ce projet de loi propose une s\u00e9rie de modifications cibl\u00e9es visant \u00e0 moderniser le syst\u00e8me de justice militaire, donnant ainsi suite \u00e0 une recommandation cl\u00e9 provenant du <\/span>rapport de l'<\/span><\/a>ancienne juge de la Cour supr\u00eame Louise Arbour, ainsi qu\u2019\u00e0 huit recommandations issues de l\u2019 <\/span>examen ind\u00e9pendant men\u00e9 par l\u2019ancien juge de la Cour supr\u00eame Morris J. Fish<\/span><\/a>.<\/span><\/p>\n

En ma qualit\u00e9 de ministre, j\u2019aimerais vous donner plus de renseignements sur les modifications que nous proposons.<\/span><\/p>\n

Avant tout, notre projet de loi donne suite \u00e0 la recommandation no 5 formul\u00e9e par l\u2019ancienne juge de la Cour supr\u00eame Arbour. Pour s\u2019harmoniser avec cette recommandation, la loi que nous proposons viendrait retirer aux Forces arm\u00e9es canadiennes (FAC) la comp\u00e9tence en mati\u00e8re d\u2019enqu\u00eates et de poursuites concernant les infractions sexuelles vis\u00e9es par le <\/span>Code criminel<\/span><\/i><\/a> qui ont \u00e9t\u00e9 commises au Canada. Cette modification conf\u00e8rerait aux autorit\u00e9s civiles la comp\u00e9tence exclusive d\u2019enqu\u00eater sur ce type d\u2019infractions et d\u2019en poursuivre les auteurs au Canada.<\/span><\/p>\n

Les autres modifications abord\u00e9es dans le projet de loi visent, entre autres, \u00e0 modifier le processus de nomination des principales autorit\u00e9s judiciaires militaires, \u00e0 accro\u00eetre les services de soutien aux victimes et \u00e0 garantir que le syst\u00e8me de justice militaire demeure align\u00e9 sur le Code criminel et le syst\u00e8me civil de justice p\u00e9nale. <\/span>Code criminel<\/span><\/i> and the civilian justice system.<\/span><\/p>\n

J\u2019esp\u00e8re que nos efforts pour am\u00e9liorer et moderniser le syst\u00e8me de justice militaire r\u00e9tabliront la confiance et feront progresser notre travail de transformation de la culture de cette institution. Alors que nous allons de l\u2019avant avec ce projet de loi, nous continuerons de travailler \u00e0 la mise en \u0153uvre des 48 recommandations de Mme Arbour.<\/span><\/p>\n

Nous avons fait des progr\u00e8s consid\u00e9rables au cours des derni\u00e8res ann\u00e9es en vue de la mise en \u0153uvre d\u2019un changement culturel significatif. Toutefois, les modifications de lois et de politiques ne suffisent pas \u00e0 elles seules \u00e0 assurer la r\u00e9forme institutionnelle durable dont le MND et les FAC ont besoin. Je compte \u00e9galement sur vous toutes et tous pour contribuer \u00e0 cr\u00e9er un lieu de travail plus inclusif, respectueux et professionnel.<\/span><\/p>\n

Les modifications \u00e0 la Loi sur la d\u00e9fense nationale propos\u00e9es aujourd\u2019hui constituent une \u00e9tape importante \u00e0 franchir en vue de renforcer la confiance et, au bout du compte, b\u00e2tir une institution plus diversifi\u00e9e, inclusive et solidaire, capable d\u2019attirer et de maintenir en poste des personnes talentueuses de l\u2019ensemble de notre soci\u00e9t\u00e9.<\/p>\n
