Par la Commission canadienne des droits de la personne<\/b><\/p>\n

\u00c0 partir du 15 ao\u00fbt 2023, les membres des Forces arm\u00e9es canadiennes (FAC) qui ont subi du harc\u00e8lement sexuel, de l'inconduite sexuelle ou toute autre forme de discrimination fond\u00e9e sur le sexe ou le genre dans l'exercice de leurs fonctions disposent d'une nouvelle voie vers la justice. Ces personnes peuvent choisir de porter plainte directement aupr\u00e8s de la Commission canadienne des droits de la personne (CCDP), sans restriction, d\u00e9lai ou r\u00e9percussion.\u00a0<\/span><\/p>\n

Ce nouveau processus fait suite \u00e0 une <\/span>s\u00e9rie de recommandations formul\u00e9es par l'Honorable Louise Arbour<\/span><\/a>, que le ministre de la D\u00e9fense nationale a accept\u00e9 de mettre en \u0153uvre. Cela signifie que les FAC ont accept\u00e9 que toute plainte \u00e9manant de ses rangs concernant de la discrimination fond\u00e9e sur le sexe, le genre, l'identit\u00e9 de genre, l'expression de genre ou l'orientation sexuelle soit transmise directement \u00e0 la CCDP, sans passer d'abord par le processus de recours interne des FAC.<\/span><\/p>\n

La CCDP a un profond respect pour l'arm\u00e9e canadienne et pour le travail difficile qu'elle accomplit chaque jour. Nous voulons nous assurer que votre plainte est trait\u00e9e de mani\u00e8re \u00e9quitable, ind\u00e9pendante, impartiale, confidentielle et en tenant compte des traumatismes subis.<\/span><\/p>\n

La CCDP traite ce type de plaintes depuis des d\u00e9cennies. Maintenant que les FAC et le minist\u00e8re de la D\u00e9fense nationale (MDN) ont accept\u00e9 que les plaintes nous soient envoy\u00e9es directement, nous esp\u00e9rons que cela aidera les personnes \u00e0 acc\u00e9der rapidement \u00e0 la justice en mati\u00e8re des droits de la personne.<\/span><\/p>\n

Le d\u00e9p\u00f4t d'une plainte aupr\u00e8s de la CCDP est un moyen gratuit, s\u00e9curitaire et confidentiel pour demander justice pour ce qui vous est arriv\u00e9. Le personnel de la CCDP charg\u00e9 du traitement des plaintes re\u00e7oit une formation continue sur les approches tenant compte des traumatismes, toutes les formes de discrimination syst\u00e9mique et les formes intersectionnelles de discrimination. Par exemple, au cours du processus de m\u00e9diation, la survivante ou le survivant n'a jamais l'obligation de s'entretenir directement, m\u00eame par vid\u00e9o, avec la personne qui l'a harcel\u00e9e. La survivante ou le survivant peut choisir ce que l'on appelle la \u00ab m\u00e9diation de la navette \u00bb, c'est-\u00e0-dire que la m\u00e9diatrice ou le m\u00e9diateur s'adresse aux parties individuellement et relaie les informations entre les deux parties.<\/span><\/p>\n
